On 28 June this year, the Minister of Justice asked the Law Commission and the Ministry of Justice to begin a joint review of the Search and Surveillance Act (the Act). The Act controls when and how Police and other law enforcement agencies can search people or property and carry out surveillance.
The Ministry of Justice are seeking submissions on whether they have correctly identified problems with the operation of the Act in our Issues Paper and, if so, what changes should be made to address them.
Submitters are invited to respond to any of the questions they have views on. It is not expected that each submitter will answer every question. Your submission can be set out in any format, but if you are not using the online survey they ask that you specify the number of the question that you are discussing.
Some consultation questions require a yes or no answer. The Ministry of Justice would appreciate it if you could also explain your reasons for answering yes or no. This will assist us when analysing submissions and deciding what recommendations to make.
Submissions will be open until 5pm on Friday 16 December 2016.
